Terms of Service

The agreement

These terms are an agreement between you and Zilbehar Ajdari, who operates Same Five at playsamefive.com. By playing or creating an account you agree to them and to our Privacy Policy, which explains how we handle personal data. If you do not agree, please do not use Same Five.

The service

Same Five is a daily challenge: every UTC day, everyone gets the same five questions, played one at a time. Each question has its own 20 seconds to answer, timed by our server. Those 20 seconds start after a short pause between questions and, for a memory question, after the item to memorise has been shown. A question not answered in time counts as unanswered. You can play as a guest without an account. A free account saves your streak, records and results across devices, puts your name on the leaderboard, lets you add friends and includes three practice sessions a day. Same Five Pro is an optional subscription described below.

Eligibility

You must be at least 16 years old to use Same Five, and you confirm this before playing.

Your account

  • Give a real email address you control; we use it to verify the account and for security messages.
  • Keep your password secure and do not share your account. Tell us at support@playsamefive.com if you think someone else has used it.
  • One account per person.
  • You can review your active sessions and sign out of them in Settings.

Fair play

  • One official attempt per person per daily challenge. Do not use extra accounts, browsers or devices to get more attempts.
  • No bots, scripts, automated answering, or tools that read or alter the game.
  • Do not share or publish answers while that day's challenge is open.
  • Timing and scoring are decided by our server. A slow connection does not cost you time you did not use.
  • We use automated checks and human review to protect the leaderboard. Results that appear to break these rules may be hidden from leaderboards, reviewed and removed. If you think we got it wrong, contact us.

Acceptable use

You must not:

  • attack, overload, probe or try to bypass the security or rate limits of the service;
  • scrape the site or use automated access, except for search engines following our robots rules;
  • access other people's accounts or data;
  • use Same Five to harass others, or for anything unlawful;
  • submit false or abusive reports.

Scores and corrections

Each correct answer is worth 2,000 points; completion time only breaks ties. If a question turns out to be wrong, we may void it and recalculate everyone's score for that challenge; leaderboards and records update accordingly. Rankings are for fun and bragging rights — there are no prizes.

Content and names

  • The questions, explanations, design and software of Same Five belong to the operator or its licensors. You may play and share your results, but you may not copy or republish the question bank.
  • Usernames and display names must not be offensive, misleading or impersonate anyone. We may require a new name or remove one that breaks this rule. You give us permission to display the name you choose wherever your results appear.
  • Share links show the result you chose to share to anyone who has the link; they expire after 30 days. Reports you send us are used to moderate the service.

Same Five Pro

The daily challenge is free and will never require payment. Pro adds personalised training, unlimited practice, a skill profile, comparisons with the field and a friend leaderboard. Pro is not on sale yet; the Pro page shows its current status. When it goes on sale:

  • It will be sold by our merchant of record, Lemon Squeezy, whose checkout terms also apply to the purchase.
  • The price and billing period are shown before you pay. The subscription renews automatically until you cancel.
  • You can cancel at any time from your account; Pro then stays active until the end of the period you paid for.
  • Refunds follow the merchant of record's policy and your rights under consumer law.

Availability and changes

We work to keep Same Five running every day, but we cannot promise it will always be available or error-free. A day's challenge may occasionally be late, corrected or unavailable. We may change, add or remove features; if a change materially reduces what a paying Pro subscriber receives, we will tell them in advance.

Suspension and deletion

  • You can delete your account at any time in Settings. What is removed and what is kept is described in the Privacy Policy.
  • We may suspend or close an account that seriously or repeatedly breaks these terms, and remove results obtained by breaking them. Where appropriate we will tell you why.
  • Sections that by their nature should continue after an account ends — such as content ownership and liability — remain in effect.

Disclaimers and liability

Same Five is a game provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

Governing law

These terms are governed by the laws of North Macedonia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims there.

Changes and contact

We may update these terms; the date at the top shows the latest version. If a change materially affects you, we will tell account holders by email or on the site before it takes effect. Continuing to use Same Five after that means you accept the new terms. Questions: support@playsamefive.com.
